The Supreme Court is set to deliver a crucial ruling today in the impeachment case of former Deputy President Rigathi Gachagua, removed from office in October 2024. A four-judge bench will decide whether the High Court panel that dismissed challenges to his impeachment was lawfully constituted under the Constitution.

The dispute centres on whether Deputy Chief Justice Philomena Mwilu had the authority to empanel a three-judge bench—Justices Eric Ogola, Anthony Mrima, and Freda Mugambi—in the absence of Chief Justice Martha Koome. That bench lifted orders blocking the impeachment, paving the way for Gachagua’s removal and the appointment of Kithure Kindiki.

Gachagua’s lawyers argue the panel lacked constitutional authority. If upheld, the case returns to the same bench. If not, past rulings may be nullified.
